$ is a just a character and it is low level (some TeX primitive)

\( is a macro and as such will be expanded possibly with more stuff 
that just a single '$' character
It makes 2 reasons for breaking robusteness
1 - the expension process
2 - The expanded stuff

But using \( allows more customization be redefining the \( command...
