The default is set  by bk10.clo/bk11.clo/bl12.clo and is set to the same value for each size. You only get the error with the 11pt or 12pt options.  But as the font size increases, the space that the header takes up increases too. But since the core document classes are frozen, this sort of thing will never be changed.
